Demystifying MGM Vs. Grokster

The MGM Vs. Grokster case is going to be centerstage for many of us next month as years of legal questioning and wrangling over issues of copyright, fair use, safe harbor and centralized control over the means of distribution continue to be argued and counter-argued.  Technological determinism and innovation is accelerating evolution in the consumption of digital media, and technology has made possible scenarios that weren’t even on anyone’s radar a few short years ago. The bottom line is that the array of digital media consumption possibilities are several steps ahead of (and butting heads with) the business models of copyright holders and there lies the rub.

There are complexities and nuances in this latest legal showdown that may seem somewhat daunting, even if you’ve been following this digital drama since the early days. Fortunately, the folks over at the Digital Music Weblog discovered a summary of the issues and relevant history over at The 463, a blog about technology public policy.

It’s a quick read that covers the core issues and the timeline while considering some questions that arise from the possible rulings.  Essential reading.
